DocentLens Terms of Use

These terms are an agreement between you and Sugaryple, a sole proprietorship registered in Japan (N&E BLD.6F, 1-12-4, Ginza, Chuo-ku, Tokyo 104-0061, Japan; contact@sugaryple.com; "we"), for your use of the DocentLens app and its related services (the "service"). By installing or using the app you agree to these terms. If you do not agree, do not use the app.

1. Who may use the app

You must be at least 18 years old (or the age of majority where you live, if higher). The app is not directed to minors.

2. The service

You photograph a museum label or exhibit; the service generates spoken commentary in your chosen language and answers your questions. The service needs an internet connection. A limited number of free captures is available per day per device; the number and the features offered may change. We may modify, suspend or discontinue all or part of the service, and will give reasonable notice where we reasonably can.

We may block access that violates these terms or endangers the service.

The service relies on third parties (including Google, Cloudflare, Apple and your device's speech recognition). Their availability and terms are outside our control.

8. Disclaimer

To the fullest extent permitted by law, the service is provided "as is" and "as available", without warranties of any kind, including accuracy, fitness for a particular purpose, non-infringement or uninterrupted operation.

9. Limitation of liability

To the fullest extent permitted by law, we are not liable for indirect, incidental, special or consequential loss, or for lost data or profits, and our total liability arising from the service is limited to the greater of the amount you paid for the service in the 12 months before the claim, or JPY 1,000. These limits do not apply to damage caused by our intent or gross negligence, to death or personal injury caused by our negligence, or to any liability that cannot be limited under the law that applies to you (including Japan's Consumer Contract Act and the mandatory consumer law of your country of residence).

10. Ending

You may stop at any time by deleting the app. We may end or suspend your access if you materially breach these terms. Sections 3, 6, 8, 9 and 11 survive.

11. Governing law and disputes

These terms are governed by the laws of Japan. The Tokyo District Court has exclusive jurisdiction as the court of first instance. If you are a consumer, you keep the protection of the mandatory provisions of the law of the country where you live, and you may also bring proceedings in the courts of that country. Please contact us first — most problems can be solved by email.

12. Changes to these terms

We may update these terms when the service or the law changes. We will post the new version here with its effective date and, for material changes, give notice in the app or its store listing in advance. Continuing to use the app after the effective date means you accept the changes. Changes do not affect a pass you have already bought.

13. General

If a provision is found unenforceable, the rest remains in effect. Our failure to enforce a provision is not a waiver. You may not assign these terms; we may assign them together with the service. These terms are provided in several languages; if they differ, the English version prevails unless the law where you live requires otherwise.

14. Additional terms for apps downloaded from the Apple App Store

These terms are between you and us only, not Apple; Apple is not responsible for the app or its content. Apple has no obligation to provide maintenance or support. If the app fails to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price (if any); to the maximum extent permitted by law, Apple has no other warranty obligation. Apple is not responsible for addressing any claims relating to the app or your possession or use of it, including product liability claims, claims that the app fails to conform to legal or regulatory requirements, and consumer protection or privacy claims, nor for the investigation, defence or settlement of any third-party claim that the app infringes intellectual property rights. You represent that you are not located in a country subject to a U.S. Government embargo or designated a "terrorist supporting" country, and are not on any U.S. Government list of prohibited or restricted parties. Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them against you. Your licence is limited to use on Apple-branded products you own or control, as permitted by the Usage Rules in the Apple Media Services Terms and Conditions.
